Governing Documents and Rules

In addition to being subject to the Condominium Act, 1998, a condominium is governed by an additional set of documents, which owners will have received and reviewed with their legal counsel when purchasing their unit.

These documents consist of the corporation’s Declaration, By-laws, and Rules.  These documents address owners’ rights and obligations and empower the Board of Directors to manage the affairs of the corporation. 

 

The Declaration is a statement of legal right, title and obligation.  It describes the condominium units and the common elements, and the rights and obligations of the corporation and its owners with regard to them.

 

The By-laws govern the day-to-day operation of the condominium and address meetings, voting, Board powers and duties, insurance, budgets and assessments, and restrictions on the use of the property.

The Asbestos Management Plan is to ensure that regulations are followed and treated as a minimum
standard at all times. This plan applies to all 136 individual residential units and the recreational
building in the condominium complex located at 2290 Orient Park Drive.

 

The Rules of the corporation are created to promote the safety, security and welfare of owners and of the property of the corporation.  They may also be created to prevent unreasonable interference with the enjoyment and use of the common elements, the units or the assets of the corporation.  In accordance with the Condominium Act, 1998, rules may be made, amended or repealed from time to time by the Board of Directors.  As living in close proximity to other residents requires that each resident exercise concern and consideration for fellow residents, most of the rules adopted by the Board simply reflect such common sense considerations.

The S98 Specifications section of the Rules refers to Section 98 of the Condominium Act, 1998, and describes modifications owners may make to the common elements.

 

Reproductions of the above documents have been posted at the left and may be downloaded or viewed online.  Familiarity with the Condominium Act, 1998, and our Declaration, By-laws, Asbestos Management Plan and Rules will provide owners with a better understanding of the organization of the corporation, and the actions taken by Management and the Board of Directors.
